File in small claims court in the county where the rental property is located. Bring: your lease, proof of the deposit paid, move-out inspection reports, photos, your forwarding address notice to the landlord, and copies of any communications. Many states allow double or triple damages if the landlord missed the return deadline or acted in bad faith.

Landlords can deduct for unpaid rent, damage beyond normal wear and tear, and costs to clean a unit left in excessively dirty condition. They cannot deduct for normal wear and tear (carpet worn from regular use, minor scuffs), routine painting after a long tenancy, or pre-existing damage documented at move-in. Always do a move-in inspection with photos.

California landlords must return the security deposit (or the remainder after lawful deductions) within 21 days of the tenant vacating. They must provide an itemized statement for any deductions. Failing to comply within 21 days without a valid itemized statement exposes the landlord to liability for 2x the deposit amount in small claims court if the court finds bad faith.
