In the US, the path turns on the sponsor's status and the couple's location. A US citizen sponsoring a spouse files in the uncapped 'immediate relative' category, so there is no visa-bulletin wait for a number — the case proceeds by adjustment of status if the spouse is in the US in valid status, or by consular processing abroad. A lawful permanent resident sponsors in the F2A preference category, which is numerically limited and can involve a wait; many LPRs naturalize first to remove that wait entirely.
For couples not yet married with the foreign partner abroad, the K-1 fiancé(e) visa allows entry to marry within 90 days, followed by adjustment of status. Whichever route applies, a genuine-relationship showing and the sponsor's Affidavit of Support are central, and recent marriages may lead to a conditional green card that must be removed after two years.
Canada lets citizens and permanent residents sponsor a spouse, common-law partner, or conjugal partner, and offers two streams. The inland stream is for partners living together in Canada and can make the sponsored person eligible for an open work permit while the application processes — but leaving Canada during processing carries risk. The outland stream is processed through a visa office even when the partner is in Canada, generally preserving the freedom to travel and re-enter.
Both streams demand proof that the relationship is genuine and not entered into primarily for immigration, and the sponsor signs an undertaking to support the partner financially for a set period. Common-law partners must show at least a year of cohabitation, while conjugal partners must explain why marriage or cohabitation was not possible. Choosing the wrong stream can cost travel flexibility or work rights, so decide deliberately.
The relationship evidence file decides most cases. Build it across the entire relationship — communication history, joint finances and leases, photos over time, travel records, and affidavits from people who know you — rather than assembling a thin folder right before filing. Prior marriages for either partner must be fully and legally terminated with certificates, and any children being included need their own civil documents.
Admissibility is where preventable refusals happen. A criminal record, prior visa refusal, previous removal, medical issue, or any past misrepresentation can require a waiver or derail the case, and the rules differ between the two countries.
