Wrongful Death Damages Calculator — Canada

Under provincial Family Law Acts (Ontario FLA s.61, BC Family Compensation Act, etc.), the spouse, children, parents, siblings, and grandchildren of the deceased can claim for: loss of financial support (dependency), loss of guidance/care/companionship, and out-of-pocket expenses including funeral costs.

Dependency loss is the financial support the deceased would have provided to surviving family members over their expected working life. It is calculated as the deceased's net income, minus their personal expenditure (what they would have spent on themselves), multiplied by the number of years they would have worked.

There is no statutory cap on wrongful death damages in most Canadian provinces. However, non-pecuniary damages (grief, loss of companionship) are capped in provinces like Ontario at approximately $100,000–$200,000 under the Family Law Act. The pecuniary dependency claim has no cap.
